Letter to the Editor: IS THE ENCANTERRA ANNEXATION EXECUTION REALLY VALID?

Queen Creek and Shea Homes officials claim that Encanterra has officially been annexed into Queen Creek. However, under Arizona State law, the Encanterra annexation will not be final until after the appellate court reviews all appeals and determines whether or not the annexation is valid.

HISTORY

At the October 16th, 2019 Queen Creek Town Council meeting, the Council approved Annexation of Encanterra into the Town of Queen Creek. On November 15th, a challenge was filed with the Pinal County Superior Court by Encanterra Residents Against Annexation. On December 12th, The Honorary Stephen S. McCarville heard arguments from both sides and issued a ruling in favor of Queen Creek late the following day which was a Friday, stating that the Encanterra Annexation into the Town of Queen Creek was properly completed.

At the earliest opportunity on Monday, Encanterra Residents Against Annexation filed an appeal challenging the judge's ruling.

FACTS

With an appeal filed, under Arizona State law, an annexation is not final until after the Appellate Court reviews all appeals and determines whether the ruling was proper.

CURRENT STATE

Despite case law regarding the appeals process, Queen Creek and Shea officials in their arrogance, have totally disregarded the law and pronounced that Encanterra is now officially part of Queen Creek. These entities have moved forward with the transfer of services and safety with blatant disregard of the appeal.

BOTTOM LINE

The Encanterra annexation is still under the appeals process. Until the Appellate Court renders their final ruling, Encanterra has NOT been annexed into Queen Creek as claimed by Queen Creek and Shea Homes.
